Notification

F 22-13/2015/VIII – The Following draft of
amendment in the Madhya Pradesh Motor Vehicles rules, 1994, which
the State Government proposes to make in exercise of the powers
conferred by clauses (f) and (h) of sub-section (2) of Section 28,
sub-section (2) of section 72, sub-section (1) and (2) of Section
96 and sub-section (1) and (2) of section 111 of the Motor Vehicles
Act, 1988 (No. 59 of 1988), is hereby published as required by
sub-section (1) of section 212 of the said Act for the information
of all persons likely to be affected thereby and notice is hereby
given that the said draft will be taken into consideration on the
expiry of 30 days from the date of publication of this notice in
“Madhya Pradesh Gazette”.

Any objection or suggestions which may be received from any
person with respect to said draft before expiry of the period
specified above in the office of the Principal Secretary,
Government of Madhya Pradesh, Transport Department during office
hours at Room No. 210, Vallabh Bhawan, Mantralaya, Bhopal shall be
considered by the State Government.

DRAFT OF AMENDMENT

In the said rules,-

(1) In rule 17, in sub, rule (1), after clause (xvii), the
following clause shall be inserted, namely:-

“(xviii) shall cause his eyes examined once in a year by a
medical practitioner referred to in rule 6, and shall keep with
him/her the certificate issued by the medical practitioner of this
effect that he is not suffering from any eye disease or night
blindness and if he is suffering from any eye disease, the same has
been cured with the help of spectacle as prescribed by the medical
practitioner and he is able to differentiate between red and green
colours and to read the number plate of a vehicle from 25 metre
distance in a day light.”

(2) After rule 20, the following rule shall be added,
namely:-

“20-A Exemption of fee for women applicants:

No fees shall be levied from the female applicants, applying
first time for learning licence.”

(3) In rule 77,-

In sub-rule (1), after clause (iii), the following clause shall
be inserted, namely:-

“(iv) that the permit holder of the state carriage shall cause
his driver’s eyes examined once in a year by a medical practitioner
referred to in rule 6 and shall keep with him/her the certificate
issued by the medical practitioner of this effect that he is not
suffering from any eye disease or night blindness and if he is
suffering from any eye disease, the same has been cured with the
help of spectacle as .prescribed by the medical practitioner and he
is able to differentiate between red and green colours and to read
the number plate of a vehicle from 25 metre distance in a day
light.”

(4) In rule 77, clause (ii) of sub-rule (1-a) shall be
omitted;

(5) In rule 77, in clause (iii) of sub-rule (1 -a), for the
figure and word “20 years” the figure and word “15 years” shall be
substituted.

(6) In rule 77, in clause (iv) of sub-rule (1-a), for the figure
and words “150 km or above”, the words and figure “more than 75 km”
shall be substituted.

(7) In rule 116, for sub-rule (1-a), the following sub-rule
shall be substituted, namely:-“(1-a) The stage Carriage service
vehicle having seating capacity of 7 persons excluding driver shall
be classified as “Rural Service Vehicle” and shall ply exclusively
on “Rural Routes” as specified under clause (ii) of rule 116 A.
Rural Service Vehicle shall be painted in blue colour on a saffron
strip on the upper edge of the wind screen and on the exterior of
both sides of the body. The size of the strip shall be 10 cm wide
and size of the letters shall be 8 cm in height and be such that it
is clearly legible from 25 metres.”

(8) In rule 116 A, in sub-rule (1), in clause (ii), for the
words and figures “exceeding 25 percent or exceeding 15 kms
whichever is less.”, the words and figure “exceeding 10 kms” shall
be substituted.

(9) Sub-rule (2) of rule 116-A shall be omitted.

(10) In rule 116 A, in sub-rule (3) for the words and figure
“less than 22” the words and figures “not more than 7 excluding
driver” shall be substituted.

(11) In rule 164, for the proviso to sub-rule (1), the following
Proviso shall be substituted, namely:-

“Provided that the said provision shall not apply to the such
motor cab and vehicles which have been issued All India Tourist
permit under sub-section (9) of Section 88 of the Motor Vehicles
Act, 1988.”

(12) For sub-rule (2) of rule 164, the following sub rule shall
be substituted, namely:-

“Every Public Service Vehicles, Private Service Vehicle,
Contract Carriage and vehicles of educational Institutions except
the vehicles designed and manufactured under rule 128 of the
Central Motor Vehicle Rules, 1989, shall have an Emergency door on
right side of the vehicle with a size of minimum 50×90 cm as
required under sub-rule (4) of rule 128 of the Central Motor
Vehicle Rules, 1989.”
